New Hampshire Mortgage Broker License Guide

In New Hampshire, anyone engaged in the mortgage banking, servicing, or brokering business must be licensed at the state level. The mortgage licenses are regulated and supervised by the New Hampshire Banking Department.

The mortgage license application process is handled by the Nationwide Mortgage Licensing System (NMLS). NMLS allows mortgage companies and individuals to apply or renew a license online.

Types of Mortgage Licenses in New Hampshire

New Hampshire has three major state license types: Company, Branch, and Individual. Each license type depends on the work you will perform.

Most Common Company Licenses

  • Mortgage Banker License - required of the principal office of companies or sole proprietorships who make, originate, or fund mortgage loans for NH properties. Licensed Mortgage Bankers can perform mortgage broker and servicer activities without obtaining separate licenses.
  • Mortgage Servicer License - required of the principal office of mortgage servicing companies who hold the servicing rights and/or record payments, as well as perform other administrative functions, in relation to carrying out a mortgage holder’s obligation under mortgage agreements.
  • Mortgage Broker License - required of the principal office of companies and sole proprietorships who engage in mortgage brokering activities for NH properties.

New Hampshire State Requirements

All license applications are to be submitted online in NMLS. Note that some agency-specific documentation, such as the originally executed bond, must be mailed directly to the Department at State of NH Banking Department, Consumer Credit Division, 53 Regional Drive, Suite 200, Concord, NH 03301 .

Education and Exams

In the state of New Hampshire passing an exam is obligatory for some, but not all license types. In order to get a Mortgage Banker, Mortgage Servicer, or Mortgage Broker license you don’t need to complete a pre-license course or pass an examination.

NH Mortgage Broker Bonds

Bonds for Company Licenses

  • Mortgage Banker License - Mortgage Banker applicants are required to submit an original surety bond in the amount of $100,000.
  • Mortgage Servicer License - Mortgage Servicer applicants must furnish a $100,000 original surety bond.
  • Mortgage Broker License - Applicants for a Mortgage Broker license must submit an original surety bond of $50,000.

Note: Copies of the bond will not be accepted. The original bond must be signed by an authorized officer of the applicant, a power of attorney, and by an insurance agent. The executed bond must be uploaded in NMLS and mailed to the NH Banking Department.
